Kentucky Attorney General Considers Appeal to Same-Sex Marriage Ruling

On Wednesday, U.S. District Judge John G. Heyburn II said that he would issue a final order within the next 24 hours ordering Kentucky to recognize same-sex marriages performed out-of-state.

In response, Kentucky Attorney General Jack Conway requested on Thursday in a two-page filing that the judge delay the order by 90 days to give the state time to determine if they would seek an appeal.

On February 12, Judge Heyburn ruled that the ban in place since 2004 “treated gays and lesbian persons differently in a way that demeans them.”
